COMPETITION TERMS AND CONDITIONS

Promotional Period

1. These terms and conditions relate to the Anchor Cream promotion (“Promotion”). Information on how to enter and prizes forms part of, and entry into the Promotion is deemed to be acceptance of, these terms and conditions.

2. The Promoter of this Promotion is Fonterra Brands (New Zealand) Limited (“Promoter”), 109 Fanshawe Street, Auckland and the provider of the prize for this Promotion is Briscoe Group Limited (“Prize Provider”), 1 Taylors Road, Morningside, Auckland.

3. The Promotion commences on 5/08/2024 at 12.01am and closes at 11.59pm on 1/09/2024 (“Promotional Period”). Entries received outside of the Promotional Period will not be accepted.

Conditions of Entry

4. All entrants into the Promotion must be New Zealand residents and aged 18 years or older.

5. Please note that employees of the Promoters and the Prize Provider cannot be excluded from this Promotion.

How to Enter

6. To enter this Promotion, entrants must, during the Promotional Period:
7. purchase any Anchor Cream product from a Foodstuffs North Island (NZ) supermarket, including New World supermarkets and PAK’nSave supermarkets, based in the North Island of New Zealand; and
8. scan the QR code on promotional material in a Foodstuffs North Island (NZ) supermarket, including New World supermarkets and PAK’nSave supermarkets based in the North Island of New Zealand, or visit briscoes.co.nz/anchor to claim the code for 60% off Tefal cookware available at Briscoes Homeware (NZ) stores (in-store or online).

7. All entries in store are deemed to be received at the time of the receipt into the Promotion database and not at the time of transmission by the entrant.

8. For the avoidance of doubt, the entry date for any online purchases is the order date (which must be within the Promotional Period).

9. Entrants may enter the Promotion as many times as they like. However, entry is limited to one entry per transaction.

Prize

10. Entrants will receive 60% off any one (1) Tefal cookware item at Briscoes Homeware (NZ) (in-store and online) valued between $49.99 RRP and $499.99 RRP (“Discount”). This Promotion excludes any Jamie Oliver Kitchen Essentials frypans by Tefal.

11. The Discount may be redeemed on orders of any one (1) Tefal cookware item at Briscoes Homeware (NZ) (including both in-store and online) until the final redeption date, which is 11.59pm on 8/09/2024.

12. The Discount is not transferable or exchangeable for cash.

13. If Tefal cookware items are unavailable in-store and online, despite the Prize Provider’s reasonable endeavours to procure it, the Prize Provider reserves the right not to substitute the Tefal cookware items with any alternative cookware items.

Exclusions and Liability

14. The Promoter and Prize Provider will not be responsible for any late, lost, damaged, illegible or misdirected entries or entries that for whatever reason, are not received by the Promoter or are incomplete, including but not limited to entries not received due to technical problems.

15. To the maximum extent permitted by law, the Promoter and Prize Provider and their related companies, employees and agencies shall not be liable for any loss, damage or personal injury suffered by any person arising directly or indirectly out of or in connection with this Promotion or claiming/redeeming any prize, or availing themselves of any prize, except as required by law.

16. The Promoter and Prize Provider are not responsible for the transmission or receipt of any incorrect information associated with entries, either caused by user error or any equipment or programming malfunction associated with the Promotion.

Use of Personal Information

17. The information entrants provide will be used by the Promotor and Prize Provider for the purpose of conducting this Promotion.

18. All entry data remains the property of the Prize Provider. All personal information will be collected and stored by the Prize Provider in accordance with the Privacy Act 2020 and Briscoes’ privacy policy (https://www.briscoes.co.nz/shopping-online/privacy/).

19. By entering this Promotion, entrants consent to the use of their information as described above.

General Terms and Conditions

20. The Promotion will be conducted by the Promoter in accordance with these terms and conditions. To the extent that any matter relating to the Promotion is not covered by these terms and conditions, the Promoter reserves the right in its sole discretion to conduct the Promotion as it sees fit, subject to any legal requirements or vary the terms and conditions as it deems reasonably necessary.

21. By entering into this Promotion the entrant agrees to be bound by these terms and Conditions and acknowledge that you have complied with all of your obligations under the terms and Conditions. The Prize Provider reserves the right to deem that any entry is void should an entrant fail to comply with any of these terms and conditions.

22. Unless expressly stated in these terms and conditions, all other expenses become the responsibility of the entrant including meals, taxes, transport, insurance and any other ancillary costs of any nature.

23. The Promoter reserves the right to request the entrant to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity. In the event that such proof is not provided by the entrant or is not suitable to the Promoter, then that entrant shall forfeit their rights to any Discount.

24. The Promoter and Prize Provider reserve the right to verify the validity of entries and to disqualify any entry or refuse to award a Discount where false or misleading details have been given by an entrant, or an entrant has behaved in a fraudulent or dishonest manner, or otherwise than in accordance with these terms and conditions of entry. The decision made by the Promoter and/or Prize Provider is final.

25. The Promoter is not responsible for any problems or technical malfunction of any web site, telephone network or lines, computer systems, servers, providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof.

26. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries.

27. If this Promotion is not capable of running as planned for any reason beyond the reasonable control of the Promoter, including but not limited to, infection by computer virus, bugs, tampering, unauthorised intervention, acts or omissions of third parties, technical failures or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Promotion.

28. The Promoter will not be responsible for any delay or failure to deliver, or damage caused to any Tefal cookware item during transit.

29. All decisions of the Promoter are final and no discussions or correspondence will be entered into.

30. Failure by the Promoter to enforce any of their rights under these terms and conditions at any stage does not constitute a waiver of those rights.

31. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion and to the full extent permitted by law, to vary, suspend or cancel this promotion.

32. By participating in this Promotion, entrants grant a perpetual worldwide non-exclusive royalty-free licence to the Promoter to use and sub-licence the use of any copyright (including future copyright) in and to any entry submitted. To the extent that an entrant has any moral rights in their entry, the entrant hereby provides consent for the Promoter and its licensees to do any act or omission that would otherwise infringe that entrant’s moral rights. Each entrant warrants to the Promoter that his or her entry does not infringe the intellectual property rights of any person.

33. These terms and conditions are governed by the laws of New Zealand.
